Desert Diamond Global Promotions Terms & Conditions

General

These Global Promotions Terms & Conditions apply to any bonuses, promotions, free bets, credits, vouchers, discounts, packages, contests, surveys, or other special offers ("Promotion(s)") offered by Desert Diamond Mobile LLC (" Desert Diamond") through the playdesertdiamond.com website or the Desert Diamond Sports App (the " App") (the website and the App being collectively referred to as the " Site") in connection with its real-money Internet-based and mobile application-based event wager services (the " Gaming Services"). The Site and the Gaming Services are referred to collectively as the " Services."

These Global Promotions Terms & Conditions are in addition to any terms or rules that govern a specific promotion ("Promotion Specific Terms"). In the event of conflict between these Global Promotions Terms & Conditions and any Promotion Specific Terms, the Promotion Specific Terms take precedence.

You should read the Global Promotions Terms & Conditions and the Promotion Specific Terms before participating in any Promotion. By participating in any Promotion, you represent to Desert Diamond that you are eligible to participate in the Promotion and you agree to be bound by, and comply with, the Global Promotions Terms & Conditions, as well as Desert Diamond's Terms of Service, Privacy Policy, and House Rules. Capitalized terms in these Global Promotions Terms & Conditions that are not defined will have the meanings ascribed in the Terms of Service.

Eligibility to Participate in Promotions

To be eligible for any Promotion, you first must establish an account with Desert Diamond on the Site. To participate in any Promotion, you also must be eligible to place a wager in accordance with the Terms of Service. To be eligible to participate in any Promotion you must:

Be twenty-one (21) years of age or older
Not have more than one account with Desert Diamond
Not be in violation of the laws or regulations of any jurisdiction whose laws or regulations apply to you by participating in the Promotion or placing a wager on the Site
Helm wagering on the Site
Not act as an agent or proxy for any other person, as part of a wagering syndicate, or for commercial or professional purposes
Not be a person on the OFAC list including being a resident of a country that is subject to embargo by the United States or that the United States has designated as a "terrorist supporting" country, or a person on any list of phroibioted or restricted parties maintained by the Untied States.
Not be included on the ADG's self-exclusion list
Not be self-suspended or self-excluded with Desert Diamond
Use our service in accordance with our House Rules
Qualify for the Promotion during the offer period set forth in the Promotion Specific Terms ("Promotion Period")

You also must satisfy all other criteria necessary to participate in each Promotion under the Promotion Specific Terms. For any Promotion in which a wager is a requirement for eligibility, you must be physically located in the State of Arizona and not on Indian Lands.

Desert Diamond will determine, in its sole discretion, whether you are eligible to participate in a Promotion, whether you have satisfied all the criteria necessary to participate in a Promotion, and whether you have earned any prizes in a Promotion.

Qualifying for Promotions

To access and participate in a Promotion, patrons must log into their account and follow the rules outlined in the Promotion Specific Terms. Unless expressly stated otherwise in the Promotion Specific Terms for a Promotion, each Promotion is limited to one (1) entry per patron. Desert Diamond may impose additional restrictions to ensure compliance with this requirement, such as one (1) entry per IP Address, residence or mailing address, and/or payment method (e.g., credit card or bank account).

The Promotion Specific Terms for each Promotion will set forth any specific requirements or conditions to qualify for the Promotion, such as making a minimum deposit into your account, making a minimum wager with real-money funds, minimum or maximum odds for a wager, wagering on a particular sport or game, wagering requirement, expiration of Bonus Money for that particular Promotion or requirement of a bonus code. Bonus Money credited to your account will require your own real-money funds to be placed at risk.

All Bonus Money credited to your account require real money funds to be placed at risk. If you a) withdraw some or all of those funds before placing them at risk on a real-money wager, b) fail to place those funds at risk as required by the Promotion Specific Terms, or c) otherwise fail to meet the requirements of the Promotion Specific Terms, then you will forfeit any Bonus Money you received in the Promotion, Desert Diamond will void any unsettled wagers made from that Bonus Money, and you will forfeit any winnings from settled wagers made from that Bonus Money, with Desert Diamond reversing any such payouts and recovering any such winnings.

A Promotion will be active (the " Promotion Period") for the time stated in the Promotion Specific Terms. If the Promotion Specific Terms for a Promotion state the Promotion Period, the Promotion will terminate automatically at the end of the stated Promotion Period. If the Promotion Specific Terms for a Promotion do not state the Promotion Period, the Promotion will terminate when it no longer is available on the Site.

Use of Promotional Funds

You may view your funds from Promotions (Bonus Money) in your Account Balance under Bonus Balance section. Although promotions are typically credited immediately upon qualification, some Promotions may not be credited for up to five (5) business days after the end of the Promotion period. Bonus Money has no cash value and may only be used for free or reduced cost wagering on the Site. Bonus Money may expire if not used within the specified period as set forth in the Promotion Specific Terms. Bonus Money that expires is forfeited and your Bonus Balance will be adjusted accordingly.

Some Promotions, particularly drawings, competitions, or contests, may be in the form of physical or cash prizes. These prizes are non-transferrable, and unless a Promotion expressly offers a cash alternative, any prizes must be accepted "as is" and Desert Diamond will not offer cash or cash equivalent alternatives. Non-cash prizes are subject to availability and, therefore, may deviate from the specific prize advertised. If an advertised prize, for any reason, is not available, Desert Diamond will, in its discretion, provide a comparable prize or a cash alternative. Any prizes that are not claimed will be forfeited. Desert Diamond will not be responsible for any prizes that are lost, stolen, or not received due to an incorrect or non-deliverable mailing or delivery address.

Desert Diamond will report any taxable prizes (whether Bonus Money, cash, or noncash prizes) from any Promotion as required by law, and withhold any taxes as required by law, but you are responsible for recording, accounting for, reporting, and paying any taxes owed to any governmental or taxation authority from your participation in any Promotions. For noncash prizes, tax reporting typically will be based on the retail value of the prize awarded.

Modifications of Promotions

Desert Diamond reserves the right, at any time, to modify, withdraw, or cancel any Promotion. Desert Diamond also reserves the right, at any time, to change the terms of any Promotion, including, but not limited to, play-through requirements, minimum or maximum odds for a wager, expiration, and other requirements or restrictions.

Desert Diamond may add to, delete from, revise, or otherwise modify all or part of these Global Promotions Terms & Conditions and any Promotion Specific Terms at any time. If we do, we will post the change(s) on the Site. If we change the Global Promotions Terms & Conditions or any Promotion Specific Terms in a material way, we will notify you in advance that we are doing so. You can review the most current version of the Global Promotions Terms & Conditions and any Promotion Specific Terms at any time, either on the App or at http://www.playdesertdiamond.com. We advise you to regularly visit the General Promotional Terms and Conditions as well as the Promotion Specific Terms as they are subject to change without notice. Your continued use of the Services after any changes means you have accepted and agreed to those changes.

Tampering and Unauthorized Use

If we determine or suspect that you are abusing or exploiting, or attempting to abuse or exploit, a Promotion, or are acting inappropriately in relation to any Promotion (including, but not limited to, by opening or attempting to open multiple accounts), Desert Diamond may, in its sole discretion, revoke your eligibility to participate in a Promotion, suspend or terminate your account, block your access to the Services, deny, withhold, or withdraw any bonus or promotion, forfeit any Bonus Money, and/or reverse any payouts made and recover any winnings.

Desert Diamond will not be responsible for any unauthorized use or tampering of our Promotionsas part of the service by any patron, group of patrons or other third-party. We will not be responsible to you if any other person abuses or exploits, or attempts to abuse or exploit, a Promotion, or otherwise acts inappropriately in relation to any Promotion, whether through circumventing the Promotions Terms and Conditions or Promotion Specific Terms, structuring transactions, or collusion.

Abusing or exploiting a Promotion may violate civil and criminal laws and Desert Diamond will have the right to pursue all legal and equitable remedies against any person engaging in such conduct.

Publicity Release

In consideration of your participation in a Promotion, you authorize Desert Diamond (and its affiliates, production partners, advertising agencies, promotional suppliers, participating vendors, and any other entity involved in the design, production, execution or distribution of the Promotion) to use your name, photograph or likeness, voice, and hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. By participating in a Promotion, you release Desert Diamond (and its affiliates, production partners, advertising agencies, promotional suppliers, participating vendors, and any other entity involved in the design, production, execution or distribution of the Promotion) from all liability in any way arising out of the use of your name, photograph or likeness, voice, and hometown and state, including, but not limited to, any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related caused of action.

Limitation of Liability

Desert Diamond will not be responsible for: (1) any inaccurate, incorrect, or incomplete information in any Promotion Specific Terms or any other communications related to a Promotion; (2) disruptions to telecommunications infrastructure, hardware, or other technical failures, scheduled or unscheduled system maintenance, denial of service or other attacks, unauthorized system access, acts of God, etc. that affect your ability to participate in any Promotion; (3) unauthorized intervention, or technical or human error, in any part of the Promotion; or (4) any injury or damage to persons or property that may be caused, directly or indirectly and in whole or in part, from your participation in a Promotion or the receipt of or use of any prize. If Desert Diamond is uable to administer a Promotion as intended for these reasons, or others (including fraud, abuse, or exploitation in or of a Promotion), Desert Diamond may change, withdraw, or cancel the Promotion and you agree we will have no liability to you for doing so.

General

All Promotions are subject to Desert Diamond's Terms of Service, Privacy Policy, and House Rules. Desert Diamond's failure to exercise or enforce any right or provision of these Global Promotions Terms & Conditions or any Promotion Specific Terms will not waive its right to subsequently enforce that right or provision unless Desert Diamond acknowledges and agrees to the wavier of its rights in writing.

If any provision of these Global Promotions Terms & Conditions or any Promotion Specific Terms is found to be invalid or unenforceable, you nevertheless agree that (a) all other provisions of the Global Promotions Terms & Conditions and any Promotion Specific Terms will remain in full force and effect and (b) an arbitrator should endeavor to give effect to the substance of the invalid provision to the full extent permitted by law.

These Global Promotions Terms & Conditions and any Promotion Specific Terms are for the benefit of Desert Diamond, its affiliates, and its Contractors, and their managers/directors, officers, employees, and agents. There are no other intended third-party beneficiaries. Desert Diamond owes no duty to you to enforce these Global Promotions Terms & Conditions or any Promotion Specific Terms, you may not rely on Desert Diamond to enforce them, and Desert Diamond will not be liable to you if it fails to enforce them.

If you have any Issue with any Promotion, these Global Promotions Terms & Conditions, or any Promotion Specific Terms, the Issue must be resolved under Sections 24 and 25 of the Terms of Service.
